Many employees are told conversations with HR or management are “off the record.”
In reality, there is no automatic legal privilege protecting workplace conversations simply because they were informal or confidential in tone.
Statements made to HR, managers, or executives may still:
• Be documented internally
• Appear in investigations
• Be disclosed in human rights proceedings
• Be used as evidence
Framing a conversation as “just between us” does not remove legal obligations or accountability.
Understanding this reality helps employees make informed choices about when, how, and what to disclose—and why documenting interactions matters.
